As we previously posted, on May 13, 2021, the CDC lifted its mask mandate for fully vaccinated individuals. New Jersey, however, did not initially follow the change to the CDC’s recommendations and, although it lifted mask mandates in outdoor settings, the State still mandated masks for most indoor settings. Effective today, May 28, 2021, New Jersey is following the CDC recommendation and lifting the mask mandate in most indoor public places as well as lifting social distancing requirements. Governor Murphy’s press release regarding the lifting of the restrictions can be found here and the full Executive Order is located here.

Although the mask mandate is being lifted, the Executive Order expressly permits businesses, if they choose, to require employees and visitors to wear masks in indoor settings. Thus, businesses will need to decide whether they will require masks and, if not, whether to require proof of vaccination from employees or visitors not wearing masks. Businesses should make these decisions with the aid of competent counsel.

Even though the COVID-19 restrictions imposed upon businesses are being lifted, COVID-19 related issues continue to evolve.
